REGULATIONS OF THE ONLINE STORE www.lollishop.eu

Art. 1 DEFINITIONS

1. Store - online store at www.lollishop.eu with all subpages where you can purchase creative works available in the current store offer.

2. User / Consumer - a natural person with full legal capacity and an organizational unit that is not a legal person, the specific provisions of which grant legal capacity, as well as a legal person who places or intends to place an Order or uses other services of the Online Store (including the Consumer) who has registered in the Store

3. Regulations - these regulations. In terms of services provided electronically, the Regulations are the regulations referred to in art. 8 of the Act of July 18, 2002 on the provision of electronic services (Journal of Laws of 2002, No. 144, item 1204, as amended).

4. Subject of transaction / Goods - Goods listed and described on the website of the Online Store. The Seller shall make every effort to ensure that the advertisement for the sale of the Goods presented on the website is up-to-date. However, if some of the Ordered Goods were not available, the Seller undertakes to immediately inform the Buyer about the situation by phone or e-mail. At the same time, the announcement with the disclosure of the photo on the Store's website is not an offer within the meaning of the Civil Code.

5. Sales Agreement - a contract for the sale of Products within the meaning of the Civil Code, concluded between the Store Owner and the User, using means of distance communication.

6. Order - User's declaration of will clearly specifying the type and quantity of Goods, aimed directly at concluding a Distance Sale Agreement via the Online Store.

Art. 2 SHOP

1. The owner of the store is Karolina Urban Lollishop, ul. Nasienna 35 95-030 Rzgów, NIP 7262681298

2. The name and content of the Store are legally protected.

3. Registration in the Store is free of charge.

4. The Regulations define the general principles constituting the legal basis for using the Store. Each User is obliged to comply with the provisions of these Regulations when taking steps to use the Store. Before using the Store, he is obliged to read the content of the Regulations.

5. The conclusion of the Agreement for the provision of electronic services between the User and the Store Owner takes place at the moment of registering the User in the Store. The contract is terminated upon deletion of the User's account at his request or by the Store Owner.

6. The User undertakes to use the Store in accordance with applicable law, social and moral standards, the provisions of these Regulations and the principles of social coexistence on the Internet (netiquette). In addition, the User undertakes not to provide illegal content.

7. Breach of the provisions of par. 6 may result in the removal of the User's account by the Store Owner.

8. All products offered in the Store are new, originally packed, free from physical and legal defects, and have been legally placed on the Polish market, and do not infringe proprietary copyrights.

Art. 3 Purchasing conditions

1. All prices listed on the Store's websites are gross prices in Polish zlotys (including VAT). The given prices do not include shipping costs.

2. Orders are accepted via the website after prior registration of the User, or without registration.

3. Orders placed via the website can be placed 24 hours a day, 7 days a week throughout the year.

4. The order is effective if the User correctly completes the order form and correctly provides contact details, including the exact address to which the Goods are to be sent, telephone number and e-mail address, and also receives confirmation of the conclusion of the contract by e-mail.

5. In the event that the data provided is not complete, the Seller has the right to cancel the Order.

6. The Buyer agrees to issue and send electronically, to the e-mail address provided by him, an electronic image of settlement documents, in particular, such as: VAT invoices with attachments, corrective VAT invoices with attachments and forms. This consent also entitles the Seller to issue and send VAT invoices in electronic form in accordance with applicable regulations.

7. When placing the Order, the Buyer may consent to the placement of personal data in the database of the Seller's Online Store for the purpose of processing them in connection with the execution of the Order. In the event of consent, the Buyer has the right to inspect his data, correct them and request their removal.

8. The Buyer may use the option of remembering his data by the system in order to facilitate the process of placing another Order. For this purpose, the Buyer should provide the login and password necessary to access his account. The Customer's login is the e-mail address provided by him. The password is a sequence of characters set by the Customer. The Customer's password is not known to the Seller and the Customer is obliged to keep it secret and protect it against unauthorized access by third parties

9. The order processing commencement time begins with the payment of the price to the Store Owner's bank account.

10. The place of performance of the contract is the seat of the Store Owner.

Art. 4 COSTS AND SHIPMENT TIME

1. The goods are sent to the address indicated in the order form or provided by phone or e-mail. The store will inform the customer immediately about an incorrectly completed order form, which prevents or may delay the shipment.

2. The goods are delivered by specialized courier companies DPD and INPOST, or via Poczta Polska (foreign parcels)

3. The shipment is delivered within no more than 5 working days from the date the payment of the price along with the delivery costs is credited to the Store Owner's bank account.

4. The buyer is charged for delivery (shipping) specified in the transport price list. The amount of fees depends on the type of transport and the method of payment. The buyer can read the price list at any time by clicking on the "transport price list" link.

Art. 5 PAYMENT

1. We issue a receipt or a personal issue (invoice) for each product sold.

2. Payment for the ordered Goods may be made by bank transfer to the Store's bank account, or upon receipt.

Art. 6 RECEIPT OF GOODS

1. Deliveries are made on the territory of the Republic of Poland and to other countries.

2. Before collecting the parcel from the post office or from the courier, check that the packaging has not been damaged in transit. In particular, pay attention to the condition of the tapes or seals affixed to the package. If the package of the shipment is damaged or the seals (tapes) are broken, do not accept the shipment and prepare a damage report in the presence of the courier and contact the seller as soon as possible to clarify the matter. Failure to find any irregularities in the quantitative or qualitative condition of the shipment upon receipt may have a negative impact on the result of considering the Customer's claims for damage or theft of the shipment in transit.

3. In the absence of the Customer or the person authorized to collect the Goods at the place of delivery, during the first attempt by the carrier to deliver the Goods, a second delivery attempt will be made the next day.

Art. 7 WITHDRAWAL FROM THE CONTRACT

1. A consumer and a one-person entrepreneur subject to entry in the Central Register and Information on Economic Activity, who concluded a distance contract, has the right to withdraw from the contract without giving a reason by submitting an appropriate statement in writing. However, it is limited in time and is only valid for 14 days. This deadline is a deadline and is counted from the date of receipt of the package by the customer. To meet this deadline, it is enough to send a statement before its expiry.

2. The law indicated in this paragraph applies to consumer sales and entities specified in art. 3855 of the Civil Code, so it applies only to the sale to a natural person who makes a purchase for purposes not directly related to professional or business activity.

3. The goods returned in accordance with paragraphs 1 and 2 will be accepted only if they are sent back fully complete, and the product itself and accessories are undamaged and do not bear traces of use, indicating that the product was used other than for the purpose of checking it.

4. In the event of exercising the right to withdraw from the contract, the returned goods should be returned at their own expense to the company's registered office address, ie LOLLISHOP, 35 Nasienna Street, 95-030 Rzgów. Parcels sent at the expense of the addressee are not collected, and the customer is charged with additional costs related to the return of the goods to the sender.

5. The return shipment must be accompanied by a written declaration of withdrawal from the contract and the account number to which the store is to return the payment. The return form can be downloaded from the website www.lollishop.eu

6. The store will check the product within 3 business days of receiving the goods together with the declaration of withdrawal from the contract. If the goods meet the requirements listed in point 3 of this section, a correcting invoice will be issued. The Seller undertakes to immediately, no later than within 14 days from the date of receipt of the Consumer's statement on withdrawal from the Sales Agreement, return to the Consumer all payments made by him, including the costs of delivery of the Goods (except for additional costs resulting from the method of delivery chosen by the Customer other than the cheapest standard delivery method available in the Online Store). If only part of the order is returned, the return is only made for the equivalent of the goods returned by the consumer.

7. The replacement of the purchased and non-defective Goods is possible only by using the withdrawal procedure as in this chapter and by submitting and paying for a new, independent Order.

8. The right to return is not due if the User has purchased a Product in the Store manufactured according to the User's specification or is used to satisfy his individual needs;

Art. 8 COMPLAINT PROCEDURE

1. In the event of non-compliance of the Goods with the contract, the User has the right to demand that the purchased Goods be brought into compliance with the contract by free replacement or repair of the defective goods. If the Store is not able to meet the specific requests, the customer has the right to demand the applicable price reduction or may withdraw from the contract.

2. In order to exercise the right to make a complaint, the User should send back the advertised Goods together with a letter specifying the type of non-compliance at his own expense to the following address: LOLLISHOP ul.Nasienna 35 95-030 Rzgów and send a statement via e-mail to the following e-mail address: sklep @ lollishop. eu, or in a message on the LOLLISHOP messenger, on Facebook. The costs incurred related to the return of the defective goods shall be reimbursed to the consumer to the account number provided by him.

3. The complaint will be considered within 14 days from the date of its receipt along with the Goods.

4. The customer loses the rights specified in the Act on the special conditions of consumer sales and on the amendment of the Civil Code, if he does not notify the store about this fact within two months from finding the non-compliance of the goods with the contract. To meet the deadline, it is enough to send a notice before its expiry. In the case of a sale that is not a consumer sale, the provisions of Articles 556-576 of the Civil Code are excluded.

Art. 9 LIABILITY

1. The Store is not liable, in particular criminal, civil and administrative, for the User's use of the Store in a manner inconsistent with the provisions of these Regulations or the law.

2. The Store is not liable for damages suffered by the User or Partner caused by threats on the Internet, in particular hacking into the User's or Partner's system, taking over passwords by third parties, infecting the User's or Partner's system with viruses.

Art. 10 PERSONAL DATA PROTECTION

1. The Store fully respects the right to privacy and the protection of Users' personal data and hereby declares that it provides information about Users to third parties only to the extent necessary for the proper performance of the services provided by the Store.

2. The administrator of Users' personal data is the Store Owner.

3. The User agrees to the collection, processing and transfer of the personal data provided by him to the extent necessary to perform the services provided through the Store

4. The User agrees to be informed by the Store Owner about any promotional campaigns carried out by him. Such information will be treated by the User as ordered commercial information within the meaning of the Act on the provision of electronic services of July 18, 2002 (Journal of Laws No. 144, item 1204).

5. The user may at any time resign from the option of receiving promotional information by sending to the address LOLLISHOP ul. Nasienna 35 95-030 Rzgów declarations of will to resign.

6. By accepting these Regulations, the User confirms the truthfulness of the personal data provided by him and in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (general regulation on data protection) agrees to their storage and other processing in the Store's database. The User has the right to access and modify the information provided.

7. Each User has the right to access their personal data, as well as the right to correct them and request their removal. For this purpose, please contact the Service Provider by letter or e-mail to the following address: LOLLISHOP, ul.Nasienna 35 95-030 Rzgów, or sklep@lollishop.eu. In the event that personal data is necessary to perform a given Service, the request to delete this personal data is tantamount to a declaration of termination of the contract for the provision of a given Service.

8. The Service Provider informs that when placing Orders in the Store, short text information called "cookies" (hereinafter: "cookies") is saved on the User's computer. The installation of "cookies" is necessary for the proper functioning of the Store.

9. The content of cookies does not allow the identification of the user. No personal data is processed or stored with the use of cookies.

10. When registering an account in the Store or later, at any time, using the appropriate functionalities of the Store, the User may agree to receive via e-mail free newsletters regarding the photos of products and collections presented on the website and other information related to the Store's operations.

11. The user may unsubscribe from the newsletter at any time, using the "Remove me from the list of subscribers" option, which is included in each sent e-mail. Unsubscribing is not tantamount to deleting your account in the Store.

12. Detailed rules for the processing of personal data are included in the privacy policy attached to this document.

Art. 11 FINAL PROVISIONS

1. The Store Owner reserves the right to unilaterally amend these Regulations and the content of the Store at any time, with the proviso that Agreements concluded prior to the amendment of the Regulations shall be governed by the Regulations as of the conclusion of the agreement.

2. These regulations come into force upon publication in the Store.

3. In the event of a dispute arising from the implementation of the provisions of these regulations and services provided through the Store, the competent court to resolve the dispute is the court having jurisdiction over the general provisions.

4. The Store and the materials contained therein, including works, trademarks, databases, their selection and listing in the Store, are subject to protection provided for in applicable law, in particular in the Act of February 4, 1994 on copyright and related rights (Journal of Laws 06.90.631, as amended), the Act of 27 July 2001 on the protection of databases (Journal of Laws 01.128.1402, as amended), the Act of 30 June 2000, Industrial Property Law (Journal of Laws 03.119.1117 as amended) and the Act of April 16, 1993 on combating unfair competition (Journal of Laws 03.153.1503 as amended).

5. To use the Store, it is necessary for the User to have a device with access to the Internet and an Internet resource browser that allows displaying websites.

6. These Regulations are available for download on the Store's website.
